In _Freedom and the End of Reason_, Richard L. Velkley offers an influential interpretation of the central issue of Kant’s philosophy and an evaluation of its position within modern philosophy’s larger history. He persuasively argues that the whole of Kantianism—not merely the Second Critique—focuses on a “critique of practical reason” and is a response to a problem that Kant saw as intrinsic to reason itself: the teleological problem of its goodness. Reconstructing the influence of Rousseau on Kant’s thought, Velkley (...) demonstrates that the relationship between speculative philosophy and practical philosophy in Kant is far more intimate than generally has been perceived. By stressing a Rousseau-inspired notion of reason as a provider of practical ends, he is able to offer an unusually complete account of Kant’s idea of moral culture. (shrink)

The question addressed here is whether evidence concerning defendants' past criminal records should be introduced at their trials because such evidence reveals their character and thus reveals whether they are the kinds of persons likely to have committed the crimes with which they are currently charged. I strongly caution against the introduction of such evidence for a number of reasons. First, the link between defendants' past criminal records and claims about their standing dispositions to think and act is tenuous, at (...) best. Second, noncharacter, or trace, evidence should have primacy in determining the guilt or innocence of defendants. Third, character evidence will vary in its freshness and specificity. Other things being equal, only relatively fresh and specific character evidence has probative value. Moreover, such evidence will have greater probative value in criminal cases where the issue before the court is whether a crime has been committed than in cases where the issue is whether it was the defendant who committed the crime. Finally, we might be more sanguine about the introduction of fresh and specific character evidence under conditions likely to work against its misuse or misinterpretation. However, the relevant conditions may not often be satisfied in the real world of criminal trials and defendants. (shrink)

In this paper I will show that the omnitemporality of truth does indeed imply fatalism if the past is unchangeable. I then argue that it is very likely indeed that the past is unchangeable and thus, since it is very likely that fatalism is false, it is very likely that the doctrine of the omnitemporality of truth is false. I argue that the rejection of the omnitemporality of truth has no undesirable consequences for either logic or theology, that in fact (...) the logical and theological consequences of the rejection of the omnitemporality of truth are beneficial to both disciplines. A promising approach to more refined models consistent with the Caplan & Waters hypothesis is based on similarity-based interference, a general principle that applies across working memory domains. This may explain both the fine details of syntactic working memory phenomena and the gross fractionation for which Caplan & Waters have found evidence. Detailed models of syntactic processing that embody similarity-based interference fare well cross-linguistically.

Audience as a function of Epideictic argumentation. This is also a critique of Stephen Toulman’s neo-Aristotelian model of rhetorical “warrant” and its connection to Charles S. Peirce’s normative semiotic of the “argument cycle.” Heidegger’s and Lakoff’s concept of discourse framing is associated with Michel Foucault’s rhetoric concept of an ethic of social discourse for the common good (parrhesia) in the age of Umberto Eco’s hyperreality media that displays Baudrillard’s simulacra, such as Donald Trump. Very few scholars discuss the moral basis of the right of persons accused of crimes to be supplied with attorneys if they cannot afford them. More discussion of the topic is needed, in particular because political theorists who prefer a minimal state deny that indigent persons have such a moral right. This article addresses their contentions by developing three arguments for supplying poor persons accused of crimes with defense attorneys. First, doing so will prevent state officials from becoming emboldened in (...) their dealings with the poor, such that they might come to pose a threat to the non-poor. Second, poor persons who believe that the state does not treat them fairly will have reduced incentives to abide by the law, which will, in turn, increase the cost of the minimal state. Third, the better off should show solidarity with the poor in demanding that the minimal state honor all citizens’ rights to life, liberty, and property. Crucial to these arguments is the claim that a right of indigent defense is unlike other welfare rights in that securing it protects other basic moral rights that minimal statists acknowledge. I defend mereological nihilism, the view that there are no composite objects, against a challenge from ontological emergence, the view that some things have properties that are ‘something over and above’ the properties of their parts. As the nihilist does not believe in composite wholes, there is nothing in the nihilist's ontology to instantiate emergent properties – or so the challenge goes. However, I argue that some simples can collectively instantiate an emergent property, so the nihilist's ontology can in fact (...) accommodate emergent properties. The United States relies on uncompensated family caregivers to provide most of the long-term care required by older adults as they age. But such care comes at a significant financial cost to these caregivers in the form of lower lifetime earnings and diminished Social Security retirement benefits, ineligibility for Medicare coverage of their healthcare costs, and minimal retirement savings. To reduce the impact of uncompensated caregiving on the intergenerational transmission of poverty, this paper discusses three possible mechanisms of compensating family (...) caregivers: public payments, deemed wage credits under Social Security, and income tax incentives. Arguing against most scholars of business ethics who have articulated a set of moral principles and applied them to problems faced by business people, Richard Lippke steers away from offering moral directives. In Radical Business Ethics, he develops a more comprehensive perspective on business issues that is tied to larger questions of social justice. We propose a framework for including information‐processing bounds in rational analyses. It is an application of bounded optimality (Russell & Subramanian, 1995) to the challenges of developing theories of mechanism and behavior. The framework is based on the idea that behaviors are generated by cognitive mechanisms that are adapted to the structure of not only the environment but also the mind and brain itself. We call the framework computational rationality to emphasize the incorporation of computational mechanism into the definition of (...) rational action. Theories are specified as optimal program problems, defined by an adaptation environment, a bounded machine, and a utility function. Such theories yield different classes of explanation, depending on the extent to which they emphasize adaptation to bounds, and adaptation to some ecology that differs from the immediate local environment. We illustrate this variation with examples from three domains: visual attention in a linguistic task, manual response ordering, and reasoning. We explore the relation of this framework to existing “levels” approaches to explanation, and to other optimality‐based modeling approaches. (shrink)

The most popular method of incorporating time into a formal logic is based on the work of Arthur Prior. It treats tenses as operators on sentences. In this essay I show a serious problem with that approach, a confusion of scheme versus proposition, which makes any system built in that way incoherent. I will compare how other formal logics deal with the scheme versus proposition distinction and find that only for formal modal logics does the same problem arise. The physical and relational structure of the biologic continuum (both internal and external to the organism) creates the information signature that is the basis for the origination of meaning in the living system. A meaning metric can be grounded in the significance of that information to the stability of the system during the process of adaptive reconciliation of divergences from the steady state condition. After discussing the interests that ground theright to democratic political participation,arguments for the disenfranchisement of thosewho commit serious criminal offenses areexamined. The arguments are divided into twogroups. The first group consists of argumentsthat are relatively independent of thejustifying aims of punishment. It is concededthat two of these arguments establish thatsome, though by no means all, serious offendersshould lose the vote for a period of time thatdoes not necessarily overlap with the durationof the other sanctions visited upon them. Thesearguments also imply (...) that the state isjustified in attempting to exclude theoffenders in question from all forms ofpolitical participation, a position thatarguably runs afoul of moral limits onpunishment. The second group of arguments makesexplicit reference to the justifying aims ofpunishment. None supports the blanketdisenfranchisement of felons, though some mayjustify it in relation to some seriousoffenders for certain periods of time. All ofthe arguments supporting the disenfranchisementof serious offenders are most persuasive on theassumption that they live in reasonably justsocieties that are genuinely democratic. RECENT SCHOLARSHIP ON HEGEL’S POLITICAL PHILOSOPHY has stressed its place in the modern tradition of reflection on autonomy and rights, thus rejecting negative assessments of Hegel as an authoritarian, post-Napoleonic “Prussian” opponent of liberalism as well as revising sympathetic readings of him as a “communitarian” critic of “atomistic” individualism. A group of eminent writers argues that Hegel, deeply indebted to Rousseau and Kant as turning away from early modern “negative freedom,” rethinks their accounts of “positive freedom” of self-determination based on (...) the principles of the general will or moral law, and embeds those accounts in the customary and institutional framework of the modern constitutional-monarchical state. Hegel understands citizenship in this state as realizing the highest aspirations of modernity for universal recognition of the autonomous personality as secured by the rule of law, systems of impartial justice, suffrage rights, and freedoms of religion, publication, teaching, and so on—under the sovereignty of the patriotic state. Furthermore, this scholarly approach to Hegel regards his conception of politically realized freedom as the heart of his whole philosophical endeavor, and it construes the dialectical arguments as providing chiefly the terms for explicating the rational will’s or practical reason’s inherent striving to actualize itself in ethically, politically, and publicly “mediated” forms of recognition. This article provides a brief background of key issues in physician burnout, a significant problem in the healthcare industry. The extent and severity of burnout are not well understood, and those seeking help are often stigmatized. A number of different approaches to alleviating burnout have been suggested, but the problem lacks any single or simple solution.We posit that an ethics committee may be well positioned to help address this issue because of its unique position within an institution. An ethics committee (...) serves the entire hospital staff regardless of department. As such it may be able to identify common elements in the development of burnout, and can serve as a conduit to administration in identifying these. An ethics committee can obtain information about the extent of burnout by conducting surveys to assess the extent and severity of burnout in an institution, and serve as a central resource to help address and alleviate it.Finally, an ethics committee may be able to act as an intermediary between practitioners and the administration, in advising the administration of the extent of the problem and offer suggestions for alleviating it. Using data collected from people with at least one brother and one sister, and consistent with an evolutionary perspective, we find that older men and women (a) are more upset by a brother’s partner’s sexual infidelity than by her emotional infidelity and (b) are more upset by a sister’s partner’s emotional infidelity than by his sexual infidelity. There were no effects of participant sex or sex of in-law on upset over a sibling’s partner’s infidelities, but there was an effect of (...) participant sex on reports of upset over one’s own partner’s infidelities. The results suggest that the key variable among older participants is the sex of the sibling or, correspondingly, the sex of the sibling’s partner, as predicted from an evolutionary analysis of reproductive costs, and not the sex of the participant, as predicted from a socialization perspective. Hartry Field has argued that Alfred Tarski desired to reduce all semantic concepts to concepts acceptable to physicalism and that Tarski failed to do this. In the two succeeding decades, Field has been charged with being too lenient with Tarski; but it has been almost universally accepted that an objection at least as strong as Field's is telling against Tarski's theory. Close examination of the relevant literature, most of it printed in this journal in the 1930s, reveals that Field's conception (...) of physicalism is anachronistic.
